What changes today

Italian Legislative Decree No 176 of 25 September 2026 enters into force on 22 October 2026. Published in Official Gazette No 233 on 7 October, it transposes Directive (EU) 2024/1799 and adds a dedicated title on the repair of goods to Italy's Consumer Code. [1]

Products covered and repair duties

The new regime concerns goods purchased by consumers and defects falling outside the seller's statutory liability. The manufacturer's duty does not apply indiscriminately to every product: it applies only to the goods, and to the extent, covered by the repairability requirements in the EU acts listed in Annex II-decies to the Consumer Code. Product category, relevant components and the application dates of individual rules must be checked. [2]

At the consumer's request, the manufacturer must repair covered goods when repair is possible, free of charge or at a reasonable price and within a reasonable time. Accessible service information and indicative online repair prices are required; prices for spare parts and tools made available must not discourage repair. [2, 3]

Importers and distributors

For manufacturers established outside the EU, the obligation falls on the authorised representative; where there is none, on the importer, and in the absence of an importer, on the distributor. Non-EU supply chains should therefore identify who manages servicing, spare parts and relationships with repairers. [2]

Preparation for a NexusDPP project

As a practical recommendation, link maintenance instructions, spare-part references, the responsible service operator and intervention records to the product model and version. Separate public information from restricted documents and assign owners and revision controls. This documentation supports preparation but does not replace the assessment of legal applicability and compliance.

Statutory guarantee rules and their transitional provisions are a separate matter. For an individual sales contract, also consult Articles 1 and 3 of the decree, without confusing the act's adoption date with its entry into force. [1, 2]
